Terms of Service – Babyverse

By accessing or using Babyverse, you agree to these Terms of Service and our Privacy Policy.

These Terms govern your access to and use of the Babyverse website and services (the "Services"). Babyverse is a product operated by BashBash Labs, trading online as BashBashlabs.com ("Provider", "we", "us").

If you or your organization has entered into a separate written agreement with BashBash Labs covering the Services, that agreement will govern in the event of any conflict with these Terms.

1) Service availability

The Services are provided on a commercial basis and may be updated, modified, suspended, or discontinued from time to time. Features, including paid features, may change as Babyverse evolves.

To the maximum extent permitted by law, the Services and generated outputs are provided "as is" and "as available".

2) Accounts and eligibility

You must be at least 16 years old to use the Services (or older where required by applicable law). You are responsible for maintaining the confidentiality of any credentials or access links and for all activities that occur under your account or session.

3) Your content ("User Content")

You retain ownership of any photos or other content you upload to the Services.

You grant us a non-exclusive, worldwide license to host, copy, process, transmit, display, and create derivative works from User Content solely as necessary to provide, operate, secure, support, and improve the Services, and to comply with applicable law.

You are responsible for ensuring you have all required rights and permissions to upload and use User Content, including copyright, licensing, privacy, publicity, and consent rights.

Temporary processing: Babyverse does not permanently store User Content. Uploaded photos and uploaded input photos are automatically deleted within one (1) hour. Generated results are saved to your account history.

4) Generated outputs

The Services use generative systems to transform images into new creative forms ("Outputs"). Outputs are probabilistic and artistic in nature and may be inaccurate, incomplete, or differ from real-world details.

You are responsible for reviewing Outputs where accuracy, authenticity, or compliance matters.

Model training: User Content is not used to train or fine-tune models for other users. We may use aggregated or de-identified usage data to improve performance, reliability, and quality.

5) Acceptable use and restrictions

You agree not to:

• Reverse engineer, decompile, or attempt to discover the source code of the Services
• Use the Services to build or support a competing product or service
• Remove or obscure proprietary notices
• Upload, store, or transmit malware, unlawful content, or content that infringes third-party rights
• Perform security testing, penetration testing, or load testing without prior written consent
• Resell, sublicense, or provide the Services to third parties unless explicitly agreed in writing

6) Prohibited sensitive data

Do not upload special categories of personal data under GDPR, government-issued identifiers, or other highly sensitive personal data unless explicitly agreed in writing. The Services are not intended for biometric identification or identity verification.

7) Fees and payments

Certain features of the Services require payment. Prices, billing terms, and applicable taxes will be clearly presented before you complete a purchase.

Payments are processed by third-party payment providers. We do not store full payment card details. By completing a purchase, you authorize us and our payment providers to charge the applicable fees using your selected payment method.

Fees are non-refundable except where required by law or explicitly stated otherwise. We may change pricing or introduce new paid features with prior notice.

8) Suspension and termination

We may suspend or terminate access to the Services if we reasonably believe there is a security risk, unlawful or infringing content, abuse, misuse, or a material breach of these Terms.

Where reasonably possible, access will be restored once the issue is resolved. You may stop using the Services at any time.

9) Disclaimers

To the maximum extent permitted by law, the Services and Outputs are provided without warranties of any kind. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.

10) Limitation of liability

To the maximum extent permitted by law, BashBash Labs shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, or data.

Our total liability relating to the Services is limited to the amounts paid by you for the Services in the twelve (12) months preceding the claim, or EUR 100 if you paid nothing.

11) Governing law

These Terms are governed by the laws of The Netherlands. Courts in Amsterdam have jurisdiction, unless mandatory law provides otherwise.
